Terms of Use

These terms apply to Barnstorm, an online card battle game for Android and iPhone, and to its website barnstorm.softick.dev, made by Softick Development ("Softick", "we", "us"). By downloading or playing the game you agree to them. Please also read our Privacy Policy.

Your Licence to Play

We give you a personal, limited, non-exclusive, non-transferable and revocable licence to download and play Barnstorm on devices you own or control, for your own non-commercial entertainment. If you got the game from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies, and Apple's terms win where the two differ.

Your Account

The game creates one account for your device. You are responsible for what happens on it. Accounts are personal: do not sell, buy, share, trade or give away accounts, and do not use another player's account. Your progress is tied to your account on our server; it may not be possible to move it to another device or recover it if the account is lost.

Online Play

Battles, clans, leaderboards, invites, replays and most rewards need an internet connection and our servers. When no other player is available quickly, you may be matched against a computer-controlled opponent, and leaderboards can include computer-controlled players alongside real ones. We try to keep the game running at all times but cannot promise it will always be available or free of bugs, and we may need maintenance breaks.

Gold, Gems and Other Virtual Items

Gold, gems, cards, card copies, caravans, essence, relics, skins, passes and other items in the game are virtual items. When you earn or buy them, you receive a limited licence to use them in the game; you do not own them. They have no value in real money, cannot be exchanged for money, goods or anything outside the game, and cannot be transferred, sold or traded except through features the game itself offers (such as clan card donations). Items are used up when spent. We may rebalance cards, change prices, drop rates and rewards, and add, change or retire items as the game evolves.

Caravans and Random Rewards

Some rewards, such as caravans, contain randomly selected items. The game shows the odds before you open them. Caravans are earned by playing; if a paid offer ever includes random items, its odds will be shown before you buy.

Purchases

Barnstorm is free to download and play. Optional purchases are sold through Google Play or the Apple App Store at the price shown there, which can differ by country. All sales are final once the items are delivered, except where the store's refund policy or your local law says otherwise. Refunds are handled by the store, not by Softick. If a purchase did not arrive, contact us with the date and the store's order number and we will help. If a purchase is refunded or charged back, we may remove the items it gave you.

Fair Play

Barnstorm is a competitive game and everyone deserves a fair battle. You must not:

• use cheats, bots, scripts, automation, modified game files or clients, or any tool that gives an unfair advantage or plays for you;
• exploit bugs or glitches instead of reporting them, or interfere with our servers or other players' connections;
• fix matches, trade wins, lose on purpose to move another player up or down, or farm rewards with extra accounts, including invite rewards;
• harass, threaten or impersonate other players or Softick staff;
• sell or buy accounts, items or services for the game outside the game;
• reverse engineer, copy, resell or redistribute the game, except where the law expressly allows it.

Our server checks rewards and can re-check battle results. If we find a breach, we may remove items, trophies or rewards gained unfairly, reset progress, remove an account from leaderboards, or suspend or close the account.

Names, Chat and Other Content

Display names, clan names and descriptions, chat messages and anything else you create or send in the game are your content. Do not post anything that is hateful, sexual, violent, harassing, illegal, misleading, someone else's personal information, spam, advertising or a link to cheats. Bad words are filtered automatically and players can report messages. We may change offensive names, remove content and restrict or suspend accounts, with or without notice.

You keep any rights you have in your content. You give Softick a worldwide, royalty-free licence to store, display, reproduce and distribute it in the game, in replays and on shared pages, for as long as needed to run and promote the game.

Shared Links, Replays and Barnstorm TV

Invite, deck and replay links open public pages that anyone with the link can see. Your battles can be shown in Barnstorm TV and in replays, with your display name, clan and deck. Share only what you are happy for others to see.

Our Content

The game, its cards, characters, art, music, sounds, text, code and the Barnstorm name and logo belong to Softick or our licensors. You may share screenshots and videos of your own play, and use the share features in the game, for non-commercial purposes, as long as you do not suggest Softick endorses you.

Suspension and Termination

You can stop playing at any time and ask us to delete your account as described in the Privacy Policy. We may suspend or close an account that breaks these terms or puts other players or the game at risk. If we close Barnstorm for good, we will announce it in the game at least 30 days in advance. When an account is closed or the game ends, the licence to use its virtual items ends too, and unused virtual items have no refund value except where the law requires it.

Changes

We may update the game and these terms. When a change is important, we will tell you in the game or on this website before it applies. If you keep playing after the change, the updated terms apply.

No Warranty and Limitation of Liability

The game is provided "as is" and "as available". To the extent the law allows, Softick gives no warranties and is not liable for indirect, incidental, special or consequential losses, or for the loss of virtual items, and our total liability to you is limited to the amount you paid us for in-game purchases in the twelve months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.
